Alcohol Policy

Please review our policy regarding the purchase and shipment of alcohol.

By participating in a battle, winning a battle, or utilizing the "Buy it Now" function (an "Activity") in a battle subject to this Alcohol Policy (a "Covered Battle"), you agree to and understand this Alcohol Policy (the "Policy"). If you do not agree to or understand this Policy or otherwise do not meet the terms of this Policy, DO NOT ENGAGE IN ANY ACTIVITIES ON A COVERED BATTLE. Any Capitalized terms in this Agreement, not otherwise defined herein, will have the terms described in the Terms of Use.

  1. Restricted States. You understand that CultWine CANNOT ship wine to the following states: Alabama, Arizona, Michigan, Mississippi, South Dakota, and Utah. Neither GovAuctions nor CultWine make any representation of any person to import wines into a state and you should pay specific attention to any applicable state law, especially, if you plan to use the wine for a purpose other than for personal use or as a gift.
  2. Representation as to Fitness to Purchase Alcohol. When engaging in an Activity in a Covered Battle, you represent that you are over the age of twenty-one (21) and not otherwise prohibited under any applicable federal, state, or local law from purchasing alcohol, including under the laws of the State of California. You understand and agree that GovAuctions has the right to request any documentation necessary from you in order to verify the aforementioned representation.
  3. Gift Cards. Notwithstanding any information or description on any battle, any Covered Battle is for a gift card from Fenn & Associates, LLC d/b/a CultWine ("CultWine") in the amount listed at the bottom of the description for Covered Battle. GovAuctions may have previous arrangements with CultWine to ensure that winners of a Covered Battle may be able to redeem their gift card for the wine listed. GovAuctions may also offer to arrange for you to use the gift card and pay for shipping of the applicable product. You are under no obligation to use the gift card for the product specified in the description of the Covered Battle, in such a case the gift card will be delivered to you electronically.
  4. Arrangement of Shipping. After winning a battle or using the "Buy it Now" function on a Covered Battle, GovAuctions will reach out to you asking you to confirm your agreement to this Policy and ask if you would like GovAuctions to arrange for you to redeem the applicable gift card for the applicable wine and have CultWine to send the applicable wine to you. You understand in performing this service, GovAuctions is simply acting as a ministerial intermediary on your behalf. You understand the gift card for the wine is being redeemed by you from CultWine.
  5. Special Shipping Requirements. You agree and understand that the shipment of wine by CultWine requires that you or someone over the age of twenty-one (21) be present and provide photo identification at the time of delivery by a common carrier. There can be no guarantee that a common carrier will provide an accurate delivery window. In shipments arranged by GovAuctions, GovAuctions will attempt to work with CultWine and you to find a suitable time for you to take delivery, however, there can be no guarantee that an optimal solution can be reached given the inherent unpredictability of common carriers.
  6. Agreement to CultWine's Terms. By engaging in an Action for a Covered Battle, you agree to follow the terms of CultWine available at https://cultwine.com/pages/legal ("CultWine's Terms") and that violation, directly or indirectly, of those terms are a breach of this Policy. You, further, agree that CultWine may take any action directly against you for violation of its terms, directly or indirectly.
  7. Title Transfer. In accordance with CultWine's Terms, for any transaction where GovAuctions arranges for you, the title will pass from CultWine to you in the State of California.
  8. Indemnification. You understand and agree that a breach of this Policy shall constitute a breach of the Terms of Use, including for the purposes of Section 32 of the Terms (relating to indemnification). GovAuctions reserves any right to any action allowed under the Terms for any breach of this Policy.
